Bannon Testimony
Brad Bannon is now testifying.
Two reactions to initial Nifong statements: "outrageous" at Nifong statements.
Second reaction: there must have been a rape. Couldn't imagine a prosecutor speaking with such confidence without his having absolute evidence that a crime had occurred.
As Bannon is reading Nifong's early statements, Nifong was sitting at the defense table with his head down.
As soon as he became involved, realized that Nifong's statements were "not truthful"--no stonewall of silence. When any figure of authority--from Duke, from the DPD--asked Evans to do anything, he did so.
The "chokehold" interview was just shown; Nifong remained with his eyes closed throughout the viewing of the tape.

Bannon is the kind of witness we all like. He is sharp, well spoken, and answers questions directly and to the point in language everybody can understand.

Nifong's words are coming back to bite him. This is only the beginning.
I'm no attorney, but my impression re. Nifong after reading this and the section on Leyn's testimony can be summed up as: "Stick a fork in him, he's done."
I kind of feel sorry for the guy, in the same way I did when I viewed the vid of Saddam Hussein's hanging.

That cost is trivial compared to what the taxpayers of NC forked over to railroad three factually innocent men.
It still makes me angry that one unbalanced DA brought so much horrow to the lacross students, sucked their families of money and faith, incited a community to hatreds, demonstrated for all to see that Duke U. has been doing a bad job of hiring (it brought in professors with the capacity to hate their students, similar to the Nazi fascist hatred of Jews), and tarnished the image of Durham, the NC legal system, and district attorneys everywhere----I for one will never trust a prosecuting attorney in quite the same way again.
I am angry that vicious people like Nifong's former campaign manager continue to assault and bear false witness against the Duke students and their families.
I am thankful for Cooper and this trial. I will not be at peace until the families recoup the millions this cost them.

We still need an explanation for his conduct and the shameful wanted posters that were produced.
Just a drive-by post on the run. I'm very angry that things came up and I wasn't able to follow the trial on Court TV today.
Was able to see some of the Meehan testimony, however. What a silly, infantile, and unprofessional little balding prick!
He was mincing every word and backtracking in order to save his business.
I also think that Mikey is going to suck every ounce of saliva from his inside jowls. Everytime I see him sitting there with his hand propping up his chin he's sucking madly on something in his mouth.
Also......(and others can check to verify this)......the nails on his right hand appear to be long. Not clipped amd manicured as most men do. UGH!--MAJOR UGH!

Perhaps it was just the lighting, but when I watched some of the Meehan testimony and they cut to Mikey, that's what I think I saw.
Someone else can check it out as well. I'd be curious to know for sure.

The SBI testimony and the initial testimony of Brad Bannon have been devastating to Mr. Nifong. Keep playing those pre-trial statements Nifong made, they are quite compelling!
So far, the defense seems to want to try the rape case, which is a tactic that will not work, the boys have already been declared innocent the top law officer in NC.
There is nothing so cowardly as sacrifing the life of innocent person(s) for one's own greedy gain. I pray he ends up in prison somewhere.

I hear that Nancy totally lacking in Grace has been AWOL from her afternoon show for the past two days. Her replacement is hosting a typical unqualified talking head discussion of the day's events.
It's good to see that some people have that Dan Rather "courage" going for them. In truth, she is a sick voyeur who has lied about herself repeatedly. She deserves the ignominy.
Yesterday it was commented that Himan could have put more effort into challenging the activities of Nifong and therefore he is "no hero". Shouldn't that comment also apply to the SBI?

Everybody stood by and did nothing. Had there been a trial and wrongful conviction, they would still have done nothing.
Everybody was 'following orders' or 'just doing their jobs'. It wasn't anybody's business or responsibility to step in and stop the insanity.
Prosecutors know this.
I've been away from a computer for a couple of days and just read the last several entries by KC. More evidence of Nifong's awareness of the bad state of evidence in support of any assault existed than I thought. As many have surmised, Nifong's prosecution was cynical from almost the very beginning, certainly before the indictments. His license is a goner. I'm surprised he didn't try to negotiate a license surrender in order to prevent making this horrible record against him.
SBI's job is to do tests and report the results, they don't conduct investigations, it is really stretching things to blame SBI for Mike Nifong's actions. SBI did their tests and produced a complete report.
Brian Meehan is culpable because he actively played Nifong's game, he left out the DNA evidence that Nifong wanted to hide and did all he could to help Nifong in keeping this evidence hidden from the defense.
If you think the Fong is having sleepless nights now, wait till he gets perp walked this fall!

Since Nifong was caught flipping the bird on film yesterday, today he's being more careful -- that's why he's taking notes, so he can go home and remember who to flip the bird at in the privacy of his own home.
Unlike most of the posters, I'm not so sure that Nifong intentionally had the non-suspect DNA results omitted from the May 10 report........ I think it's at least as likely that he was very sloppy, and never really studied what he was turning over to the defense. In a way, I think we give Nifong too much credit when we construct these intricate plots.... maybe in the end he's just a lazy, egotistical fool, not some evil genius plotting to hide evidence............

That is a very low standard of human accountability and speaks volumes. Just do your job. Don't worry about the rightness or wrongness of the situation. Let someone else handle it.
SBI isn't being blamed for Nifong's behavior. It is merely being pointed out that they, along with everybody else, felt no obligation to stop an obvious railroading.
I guess I was hoping for better.

I found DIW and started actively tracking this case about the time of the December hearing. Meehan's testimony at that hearing was clear. Meehan testified he and Nifong "agreed" not to reveal the additional DNA. They said it was out of "privacy" concerns.
Today's story from Meehan is dramatically different from his hearing testimony.

As big a joke as complaining about a rookie detective at the DPD not going public against the DA, the idea that the SBI could have stopped Nifong is a bigger joke. The SBI gets a limit amount of evidence to evaluate. They have not read the case file. They have not read the medical reports. They have not read the witness statements.
How would they know a frame was going on? The press! By that standard they should not have wasted state resources even to do the DNA tests. The press had already told its readers Mangum was raped. By your standard maybe the SBI should have just reported matches to confirm what they "knew" from the press?

I am unable to watch live, but finally got to see a clip on WRAL of the Meehan questioning. Perhaps it is because I have only seen this clip, but the questions from the prosecution fellow seem slow, stumbling and pointless. Like he hasn't done any homework and is unclear of where he's headed. Please someone tell me that clip was not representative of his questioning so far! Did I glimpse the dull part of a larger strategy?

Let's see in early April 2006, I was watching the amazing conclussion of my Gators winning the NCAA men's basketball tourney. I then went to a conference in Bolder, Co. I had a vague understanding this case was going on. I certainly did not KNOW a frame was going on until the that summer when the discovery file became public.
If you know a lacrosse player and I admire your loyalty but my view is you jumped to a conclusion about this case also if you formed an opinion before the DNA evidence came back. That is unless you were at the party. I certainly became suspicious of Nifong after the NCCU candidate's forum. But I did not KNOW a frame was going on until it became clear that summer. You do remember the DNA was tested in April?
I was at work all day. Are there video highlights or transcripts posted anywhere?

That being said, for all of the hard work KC, Johnsville, Liestoppers, JinC etc. have done, I still find myself banging my head against the wall of "something happened" on blog after blog.
Nifong may be getting his just desserts and DPD may have been exposed as yet another department with its share of corrupt officers, but there are still thousands of people who have trouble understanding just what the word "innocent" means.

Too bad that won't happen. Right now, the only way for Nifong to leave is if he resigns. NC had a judge disbarred last year that stayed on for 4-5 months drawing a paycheck before he finally resigned.
Can somebody answer a question for me. Do I understand that Nifong hid the SBI report from the defense teams? If I understand what I'm reading, the defense should have known that there was no DNA very early on.
Not specifically about Bannon's testimony; but I thought some here might be interested in a youtube clip of Himan's testimony yesterday. It specifically focuses on Himan recounting Nifong saying "You know we're f*cked." What's particularly funny is it's clear the attorney wanted to make sure panel heard the quote and Himan was speaking rather quietly so he makes him repeat it again and again and again ... and then repeats it himself!

No one is alleging Nifong hid SBI report. SBI report didn't find any semen/sperm on Crystal, but they were using conventional DNA testing, which is not as sensitive as what Meehan was using. Meehan was doing Y-STR tests.

Has the judge looked at the actual forms from other "final" reports and compared it to the lax "interim" report; most medical lab reports all very carefully labelled and identified because it determines where they are placed in a medical chart etc. It would be of interest to see if there is anything that distinguishes this report in its form, labeling title, color of paper etc. My bet is that the "final" report excuse was a carefully crafted method of trying to avoid the discovery law. If this guy has only done 100 rape cases he maybe looking for business(there tens of thousands per year) and helping Nifong nail Duke Lax would be a boondoggle to his business. No reputable lab would come up with this explaination unless it was clearly marked as an interim report.
Is Nifong really going to testify? I can't wait for the cross . . .

Well, that may be your view. However, your view is shortsighted, since it treats "loyalty" as the only possible reason why someone might form an opinion before the DNA evidence is back. Are you telling me that there is no one in this world that you know well enough, and trust enough, that if they told you "I'm accused of this crime, but I didn't do it," you could say "I believe you because I know you and I know you wouldn't do such a thing"? No matter who it is, no matter how close you are, your reaction would be "Well, you may be my best friend in the world, but I'm sure not going to believe you when you claim you didn't rape someone; I'm going to wait for the DNA evidence, because I trust that more than I trust you"?

The defense knew and had a press conference to announce that there was no DNA match back in April or May 2006. [Also Chesshire said after the Evans indictment that the DNA security lab found nothing more than the SBI found but Nifong still indicted after declining to indict base on the SBI results.] So the defense did know there was no DNA match early on. Meehan kept calling the partial match of Evans on material on the fingernail a match but it is not by the usual standards. [That is part of the reason I have said a few times, people have made too much of the 15 December hearing.]
What was discoverd by Mr. Brannon, I believe, before the 15 December hearing is that the DNA of other unidentified males was on Mangum or her clothing. The Perry Mason moment at the 15 December hearing was Meehan saying Nifong told him to omit that information from his report.
What I think we heard today was that the SBI found DNA of unidentifed males on Mangum too. There was no follow up on was whether or not that part of the SBI report was given to the defense.

The SBI lady noted, there was an unusual amount of materials to test in the rape kit. More than she had ever seen. Way to go Manly and Levicy - conclusion no evidence of rape existed.
Liestoppers is a good blog, but not as good as KC's.
KC does it all himself. I like the variations on Liestoppers, but think that the Joan Foster stuff gets a little old. She's good, but not that good. Sometimes it's just plain silly.

I knew from nimute one those guys never touched those dirty girls. Due to my emergency department and life experiences. The story never hung together.
In general, the people who come to KC's blog are more intelligent and interesting to read.

Within 24 hours of first hearing of the incident, I was convinced it was a hoax. Why? Because I was brainwashed by the metanarrative.
A bunch of college-educated white boys gangraped a black stripper in a house filled with dozens of other students? C'mon, be serious. That's only slightly more believeable than an accusation of Amish women heading up a car-jacking ring.
Like the boys' lawyers, I didn't have to wait for any DNA tests to tell me what commonsense, unpolluted by the 88's lying metanarrative, already did.

I find that the regular posters on the LieStoppers board are actually quite intelligent and interesting. Most of them have moved from CTV to Talkeft to LS. The influx of new posters since even the most mildly interested readers have discovered the Hoax has caused some problems, but it does well representing it's viewpoint. Based on the large number of Duke parents and alum that post over at LS, the comment about them being "average joes and janes" might be out of place.
It was Titus and Stephens duty as Judges to stop Nifong. They are to blame for the nine month fiasco, along with Nifong. Put the blame where it belongs and not the supporting cast. If we had every cop,lab tech,nurse and anyone else "standing UP", the country would be in chaos. The cops reported what was going on to their Superiors. Again, we got people sacrificing other folk livelihood for a perceived "duty."
The people at Liestoppers, 9:50 would be the first to agree with you, that they are special. I am not so sure. No one would accuse them of being open minded to new ideas.
The lawyers have thanked K.C. also. Last I checked, they didn't check in here to talk to all the posters of superior intelligence now did they?

KC please clear me on this:
Did I hear correctly today, SBI agent Jennifer Leyn testify that her final report concluded there was no Duke Lacrosse DNA present from the Mangum rape kit, but another unknown males DNA present? If so, Nifong knew there was exculpatory evidence before he even went to Meehan's DSI lab for tests.
What "new ideas" do I need to explore in this case? I want justice to prevail and be equal for all. Is that a "new" idea to you 9:53?

One last question if I may. There is an unswered question of: Was the other unidentified male DNA withheld from the defense in the SBI report? This you told me above if I understood. Why wasn't Wade Smith questioned about the SBI report. I would think the first question to Brad Bannon would be "Was the other male DNA reported there?" I guess I'm missing why they don't go after this blatent opportunity? The state lab found it in their work a year ago and the agent stated as such. More withholding evidence

Just read KC's previous post on DNA found by SBI. It was not found on Mangum, it was found on a towel and the bathroom floor.
I find the Liestoppers bashing unwarranted, and there were reasons to question this thing before the DNA came back. Conflicting things were being reported and Crystal said her Father came to the hospital to see her, see had to report it all for him -- then the Father is quoted by AP reporters saying he didn't know anything about it - and he saw her the next day and she looked fine!

The JLS here does not have all the facts straight on the case and shows a few times that he/she does not know them. Can't even tell us when the DNA test results were announced, either time samples were sent for tests to be conducted.
I thought the JLS @ LS had more knowledge of the case facts.
Where is the clip of Victoria Peterson? Nothing seems to be discussed about her in the N&O except a very tiny excerpt reporting that she was barred from the proceedings.
Her antics must have been hilarious.
In the H-S, it is reported that during the lunch break when everyone was going through security check, Peterson was near Jim Cooney and Mary Ellen Finnerty as they were walking back inside.
Peterson went over and touched Mary Ellen and told her that she and most of Durham think that her son did something to Mangum.
Jim Cooney subsequently went to the head of the State Bar panel who then had Peterson banned for the remainder.
Mary Ellen is now being escorted by security. Cooney said that he was concerned that she might have been physically harmed.

Maybe KC is partying or schmoozing tonight. Or maybe just getting some sleep. He's got to be dressed and at court at what? 8:00 AM? and it runs to 6:00 PM. Then analyze the day's events for a summary. And of course he may have access to people there for some great inside commentary.
Reminds me of when I was younger and spent more time on the road. Business trips were like working 16 hours a day. Sometimes 24.

Yep that is question of the day. Here is how I view it:
1. It should be clear to everyone by now Mangum is a hooker, was lying about no sex for a week prior to the lacrossse party and probably had to have lots of DNA from various males on her.
2. DNA security found that DNA but failed to disclose it in there only report on this case until the AG took it over.
3. What is new today is that the SBI found DNA from other males on Mangum and reported it to Nifong.
The question we are left with is did Nifong disclose the total of what the SBI reported to him to the defense.
If so, this make the issue even more less that evidence was hidden from the defense and more that Nifong hid evidence he was required to disclose and lied to the court about it.
The SBI didn't find any DNA from other males on Mangum. The only items submitted for DNA testing were the fingernails, the floor swabbings, and the cuttings from Evans' special towel.
JLS needs to put down has glass crack pipe and let up some.

What was also new 0 Ms Leyn made stated "The lab received an unusual amount of materials in the rape kit." She did not criticize the collection of materials or state it was a bad job. Then, how would she know, she works at the SBI lab and not a blogger or nurse. Yeah, Dr Manly and Nurse Levicy.

Ole Polanski might be right this time. If you look at those pictures inside the house that night when the two strippers were on the floor, Mangum was flailing about, the expressions on the faces of the lacrosse players were very negative. No one was smiling or laughing and having a good time.
Their expressions remind me of when someone is sick, about to throw up and are trying to get through the experience.
It really looked like they didn't want those women to be there but were reluctant to make them leave. The whole thing was a scam.

I think he has done 2000 cases and 100 of them were rapes but he used both numbers. He said he has done 2000 reports and the lax was the only one that he did not characterize as "final"; when asked how many rapes he had evaluated he said 100. There must be reporting standards if not formats themselves for these reports; this whole "final" vs "interim" report thing is a ruse and the core of whether there was deliberate withholding of evidence. Meehan and Nifong are in the soup together and probably concocted this scheme as a way to withhold evidence and have this as an out. Hopefully the lawyers will have time to compare the format of the lax report with the format of other 'final" reports.

I checked the front page again and the insulting LS clone has an element of truth in its bitterness. The SBI other male DNA were from the towel etc.
So I guess the point of that part of the cross was that the SBI reported those other male DNA while curiously according to Meehan for the only time in history DNA Security did not report such DNA findings. And of course DNA from other males on Mangum is much more exculpatory than DNA from unknown males on other articles in the evidence.

This evening I took a look at Health Insurance Portability and Accountability Act (HIPAA) of 1996, Public Law 104-191 with compliance dates of 2003 and 2004 http://www.hhs.gov/ocr/hipaa/
I see that covered entities must implement standards to protect and guard against the misuse of individually identifiable health information. Failure to timely implement these standards may, under certain circumstances, trigger the imposition of civil or criminal penalties.
Surely, all labs are covered entities and would be required not to release that information unless the person gave permission or the courts ordered the information released.
I can't imagine any more private information than a persons DNA.
Is anyone familiar with HIPAA with respect to this case and gak's question?

I agree, I was most curious that when Nifong was given control of police resources, he also got day-to-day control of what Addison and Kammie Michaels were told to put out, until Major Lee Russ ended the defamation after around 10 days,
It seems that the Bar would be interested to discover the extent of Nifongs unprofessional comments and remarks. It waould be bad enough if he was inflaming the community, needlessly tainting reputations, and poisoning the jury pool on his own. It would be worse if he had Addison and Michaels operating under his orders as proxy defamers in a coordinated media campaign.
I noticed and pointed out at Liestoppers and with John in Wonderland that Nifongs and Addison's remarks tended to mirror one another and feed off one another.

If I have a critique, it is about the lynch mob mentality and constant clamor to criminalize anyone that some think had any negative role with respect to "our Reade, our Colin, our David.." A not so unusual thread begins as a poster writes how Wahneema or Curtis or all the ADAs, Brodhead, Clayton, Manly, Meehan, etc. should "spend their whole lives behind bars" (after they are fired) and the whole pack rises up and brays about other punishments they'd like to see and various vengence fantasies.
Many, including Bill Anderson, don't seem to know what they are talking about insofar as what is criminal, what is truly a tort, and what is just moral squalor....so they go over the deep end, and it sounds like schoolyard bully bluster little different than the Chan Hall perspective..
All in all, though, 95% of the time the discussions are smart, level-headed, and civil.
And debates on what Levicy, for example, did wrong, can go on for weeks with some pretty high IQ, high expertise people commenting.

I think this sums it up well. But to me that makes everything else there suspect. You just can not expect or trust information from biased people.
I too am very interested in Levicy. I stand ready as I have for a couple of months now to be convinced she did something that is actually legally wrong rather than just offer her wrong biased opinion. Time will tell.

JLS- What % of the members over at Liestoppers know ANY of the players on the Duke lacrosse team? What % of the members know anything about men's lacrosse? The fact that so many people from all over the country from various backgrounds, education and political views came together on this site and Liestoppers contradicts your assertion that its "friends and family" over there. That people came to enjoy the sport after posting on the Frame for months is not surprising. People like to identify with sports teams for lots of reasons, it is a common bond and one of the major reasons colleges and universities feature sports when extorting money from alumni. Maybe you aren't a sports guy. I further suspect that this site would not be here if the group of people had nothing to do with rabid, foaming at the mouth, agenda driven college professors. Most ended up here driven by some interest other than lacrosse or personal friendship with the Duke players.
fair is fair...I did arrive at the discussions because of lacrosse for the first few week, back on the old triangle boards. After I figured out it was a scam, my interest became the pursuit of justice for the players and a resumption of a fair government for all. My NCAA Championship thread died over at LS, if you want to talk lacrosse, go over to the Inside lacrosse forums. The fact that Phillip has devoted his page 2 section to an U.S. citizen railroaded in a third world central american country dings up your theory some more, JLS.

Anyone on the "street" would have had better sense than to trust the people in "authority" at Duke and Durham. Of course, it goes to the upbrining and training of these young men that they would trust. It is because we must and will trust them in their careers and lives like the young lacrosse player who gave his life serving his country. This isn't about who they are anymore. It is about a lot of sorry, untrustworthy people at Duke and Durham some of whom hold higher degrees of education that are essentially worthless.
A Question for My Fellow Posters
Did the boys' attorneys request a change of venue because of Nifong's prejudicial statements to the media, or was the venue change prompted by blacks' history of antiwhite group-think?

I agree. Why do an interim report after all the results are available.
Meehan may have committed a crime by conspiring with Nifong and is looking for an alibi.
I don't believe Mr. Williamson and the two other panel members were the least bit impressed with Meehan's tap-dance routine. I believe they will correctly conclude that his testimony was not credible in any way. The "interim" report didn't appear until this hearing--it wasn't mentioned in the December testimony. Nifong's lawyers can spin this all they want, but the panel's attention is rivetted on the central points of their complaint. I am quite satisfied with the way things have gone thus far.
