Nifong's False Apology

At this point in the case, it would be hard to imagine anything that Mike Nifong could do to increase the contempt with which he should be viewed. But he’s managed to do so, issuing an apology that:

(1) blames Crystal Mangum and Mangum alone for his pursuing indictments without probable cause;

(2) suggests that only the new evidence brought to light in the AG’s inquiry explains Roy Cooper’s decision to dismiss and proclaim the players “innocent”;

(3) suggests that some of his initial actions might have been correct;

(4) urges those that he harmed not to pursue civil cases against him.

As Collin Finnerty correctly noted, "It may be an apology, but it doesn’t make me feel any better…for what I’ve gone through. It was his actions more than anybody’s that caused the harm. I don’t think anyone is going to feel better after that apology."

1.) “It’s Crystal’s Fault”

Nifong blandly asserts, “we all know that no system based on human judgment can ever work perfectly. Those of us who work within that system can only make the best judgments we can based on the facts available to us with the understanding that those judgments may have to be modified as more facts become known.”

Mangum, certainly, deserves the strongly possible censure. But the idea that she is the primary person responsible for this hoax is absurd. To remind Nifong:

He—not Mangum—instructed the Durham Police Department to violate its own procedures and confine the April 4 lineup to suspects;

He—not Mangum—refused to meet with defense lawyers to consider exculpatory evidence.

He—not Mangum—made dozens of procedurally improper statements, including statements that he knew or should have known were untrue.

He—not Mangum—entered into an agreement with Dr. Brian Meehan to intentionally withhold exculpatory evidence.

Nifong’s attempt to blame everything he did on Mangum is, in short, beneath contempt.

2.) “New Evidence Was the Key”

Nifong wrote, “Obviously, they have had access not only to all the evidence that I had, but also to additional evidence that I have not seen which they developed during their twelve weeks of independent investigation. I have every confidence that the decision to dismiss all charges was the correct decision based on that evidence.”

Perhaps Nifong misunderstood the AG’s statement, though I found it crystal clear. Cooper said that there was no evidence to sustain these charges, and the players were innocent. He did not say the evidence that Nifong handed over to him could have been interpreted in such a way to establish guilt.

In this clause, Nifong effectively is saying that Cooper inaccurately characterized the evidence in the case.

Nifong also—outrageously—asserts that he and the AG’s office followed the same approach to the case. He commented, “. Those of us who work within that system can only make the best judgments we can based on the facts available to us with the understanding that those judgments may have to be modified as more facts become known. That is the process I used in these cases, and that is the process the Attorney General used in these cases.”

This is the same man who repeatedly refused to meet with defense lawyers to consider exculpatory evidence. And this is the same man who told Susannah Meadows of Newsweek that no facts that had emerged in the case after he initially expressed his opinion (March 27) altered his opinion.

In short, Nifong was the epitome of closed-mindedness, a figure who defiantly proclaimed that his judgments would not “ have to be modified as more facts become known.

3.) “I Was Partially Right”

The disgraced DA asserts, “To the extent that I made judgments that ultimately proved to be incorrect, I apologize to the three students that were wrongly accused.” [emphasis added]

To the extent? What is Nifong talking about?

What judgment he made in this case was not “proved to be incorrect”? The comment harkens back to the typical Nifong innuendo, the hint that this classic emperor with no clothes had something in reserve.

4.) “Don’t Sue Me, Don’t Disbar Me”

Nifong concludes,

I also understand that, whenever someone has been wrongly accused., the harm caused by the accusations might not be immediately undone merely by dismissing them. It is my sincere desire that the actions of Attorney General Cooper will serve to remedy any remaining injury that has resulted from these cases.

In other words, the fact that Roy Cooper did his job and performed courageously means that those who committed misconduct in this case—most prominently Nifong but also the Durham Police, some Duke professors, some in the media (such as Wendy Murphy), and perhaps the Duke administration—should not be held accountable for their actions.

Such a statement suggests a figure who long ago lost touch with reality.

Just issuing an apology now, after he has resigned from the case, the accused have been declared innocent and all charges have been dropped, is itself adding insult to injury. It can only serve to further enrage his critics, notwithstanding the content of the apology, which, as Professor Johnson says, is contemptible.

KC, what you are missing here is that Nifong didn't draft this statement, his lawyers did. They evidently have lost touch themselves.

Nifong deserves all the condemnation he receives, but this apology is nothing more than an attempt to sway the bar.

I also think that point 1 is only partially correct. While Nifong is the primary actor in the Hoax once it got started, the ENTIRE hoax would not exist if CGM hasn't falsely accused the players in the first place. While I believe that Nifong deserves actual jailtime for some of his crimes, Crystal does too.

Durham's Black community, as well as the 'Gang of 88', should be "up in arms" about the way Nifong(D) used them to advance his political career.

He used a "true and tested" southern Democrat tactic.

During the 1950s, and the 1960s, the Southern Democrats used white bigotry and white fear to stay in power. They would mix a confused, falsely accusing, white girl with black males, and BANG!: Re-Election assured! You have the same criminal case that was falsely brought agains't the Duke white males.

The only difference in this case is Nifong(D) used a black girl instead of a white girl to get elected.

As for the other 87, I do hope they were listening to AG Cooper's statement.

BTW: I jumped the gun a bit on today's post because I'm in the airport and was scheduled to be in the air at 12.01. Alas, my flight down to RDU for Nifong's hearing tomorrow is delayed . . .

I do find some comfort after watching Nifong's lawyer on Fox News tonight. He is clearly an idiot, not only because he volunteered to defend Nifong and commit career suicide, but also because couldn't articulate one argument in defense of his client.

For example..... the reason that Nifong did not interview the accuser is because he did not want to become a witness in the case.

Amazingly, Nifong has managed to dig his own grave even deeper than anyone thought possible. If I was the bar or the falsely accused, this statement would piss me off more than anything. Nifong would have been better served to have said nothing. He has the audacity to suggest he had some part of the declaration of innocence yesterday. It is as if he is saying "Hey I am a good guy too, I also did the right thing." Jim Coleman said it best, he is mooning the system.

Nifong continues to conduct himself as if he is very smart and everyone else is completely ignorant.

There is a short but excellent interview of Susannah Meadows of Newsweek on Charlie Rose (who has a BA and JD from Duke). She said very nice things about Reade Seligmann, who she got to know well during the year. She said Reade always had tremendous confidence in the truth, despite the darkness. In re-reviewing the amazing inconsistencie in the accuser's statements yesterday, it struck Meadows that the accuser was effectively begging Nifong to dismiss the charges. But for the ethics charges, Meadows is convinced Nifong would never have dismissed the charges, notwithstanding the defects in the record. She said she would suprised if the families did not file lawsuits against Nifong.

Ar least one chapter of the Johnson-Taylor book should focus on the role of the two local newspapers — the News & Observer and the Herald-Sun — in the formative stages of the hoax/frame-up. Neff's later coverage was excellent, but the late March-early April 2006 N&O coverage helped set the stage for Nifong and his enablers. Publishing the vigilante poster (see John in Carolina), the Khanna-Blythe coverage (calling the anonymous false accuser the "victim" repeatedly), the Sheehan columns, et al.

New evidence? This case involved the same damned evidence Nifong had. The SPs interviewed witnesses, which is something that the POS Nifong never did. But, then, he did not want to find exculpatory information, so why interview someone who messes up a good story?

Keep the heat on this bastard, and I will do the same. Damn! It is almost midnight, and now Nifong won't let me sleep.

My guess is that after Cooper was done with him on Wednesday, Fong was wishing he had been wearing a pair of the NASA diapers.

Nifong's assertion that the special prosecutors reviewed additional evidence is correct. What he neglects to mention is the most persuasive evidence was likely the alibi evidence provided by the defense attorneys Nifong steadfastly refused to meet with.

I think Nifong is showing some dim understanding of just how bad a spot he's in.

The stark nature of the AG's dismissal really cut the ground out from under him. He's now toxic - both those who oppose him and those who've long supported and enabled him now agree that he needs to be flushed down the toilet. I just can't see what would cause either the Bar or the AG to be other than ruthless with him. Both politics and justice call for his destruction.

His apology is a desperate attempt to save himself from what looks to be unavoidable. It's both horrible and fascinating to watch him circling the drain.

It seems quite possible that Nifong's final act will be to take his own life. He has lost, or will shortly lose, many of the things he appears to value.

His law license, thus his profession
The respect of his peers
His elected office
The community's respect
His pension
His health (prostate cancer)
His freedom, perhaps

Does "self-respect" belong on this list? For someone who publically displays the conscience of a sociopath (i.e. none), it's hard to say.

Nifong has done plenty to earn the contempt of everyone on this board, but I give him some credit for this apology, Sure he avoids taking responsibilty for his actions (given his current and soon to be pending legal problems, I wouldn't expect more), but he also unequivically acknowledges that the Duke players were "wrongly accused".

He didn't have to do that. In fact, I can see why his attorney tried to distance himself form the statement - it does his legal and ethical cases more harm than good. But to the extent it does anything to satisfy the georgia gosling, wendy murphy, "something happened" crowd, it's the first decent thing Nifong has done in this case.

I believe that the best thing these boys can do for the accuser and for themselves with respect to the accuser is file a civil suit against Crystal Gail Mangum seeking that she submit to a full psychiatric evaluation and agree to be counseled for at least a year.

As for Mikey, I think they should take him for every cent they can get.

With Nifong controlling the trial calendar,he planned on this thing going on forever. I read and inmate jailed four years (unable to make bail) without a trial sued North Carolina. The judges ruled his sixth Amenment rights were not violated.

So, I'm wondering. What really happened?

Mangum had 3-5 semen samples in her vicinity. They had to have gotten there some way. It's possible that she was raped at some point that day or the previous one but was so strung out that she simply didn't know what was going on and just assumed that she had been rape at her last dancing appointment. Isn't it?

Otherwise, she either gave it away to 5 guys just prior to the party or gave it away to 5 guys by the side of the road, out the window of the car as she was being driven to the Kroger on Hillsboro.

Seriously, I actually interested to hear what happened to this mentally unstable prostitute just prior to the party. Anyone have a reason to believe one explanation over another.

Nifong needs some serious time.

I believe that one cause of this
travesty is that DAs have no reason to fear the law that they so readily wield against others.

Roy Cooper's suggestion that the state should be able to take a DA is a start, but it does not go nearly far enough.

I would propose the following law:

If a state's attorney fails to discontinue a case, even though he has, or a reasonable person in his shoes would have, knowledge that the accused is innocent beyond a reasonable doubt, he shall be subject to the same term of imprisonment as the accused would have been, if found guilty.

So in this case, Nifong could be sentenced as if he had comitted a rape.

The other thing is, we need sting operations to catch bad DAs. Just as Dateline NBC goes after sex predators, the police can bring a "case" against someone, then give the DA overwhelming evidence that the accused is innocent. If the DA fails to terminate the case after enough such evidence is piled on, then "bang" you've got him.

No way. Nifong chose, deliberately, to pursue this case in the most cynical manner. I daresay it fit his personal worldview and selfish ambitions perfectly, damn the pesky "facts" and "evidence."

I've followed this case with dread up till now, horrified by the injustice done to Dave, Reade and Collin and the Duke LAX program.

Now on I'll follow it with relish as Nifong and his corrupt cronies face the justice they chose at every opportunity to deny the accused.

Sure, he acknowledges that the players were wrongly accused...by the nutcase woman who accused them. Did you miss the part where he blames her? This statement was nothing but self-serving ridiculousness. He did this to save his ass, although it appears to have made him even more of a joke, if that's at all possible.

The N&O reported in March that Mangum was an honor student at NCCU, and had got "an A in a difficult course". Was that the Differential Equations class or the Thermodynamics class? There was Nifong's Duke Rape Hoax, but also there was the N&O's own Hoax, the creation of their perfect victim. KC must not underestimate the damage they did. Where was their due diligence? They used Mangum just as Nifong did,and worse, notwithstanding Neff's too little too late reporting. The heart and soul of that paper is still intact, as is their contempt for Reade, Collin , Dave and their families. When will Ruth Sheehan apologize for calling Mrs. Evans "arrogant" when Evans defended her son on "60 minutes"? Never. All we've done is win one battle. They are just lying in wait, ready to pounce again. They even will eat their own; ask Imus.

1. Mangum is or at least then was a hooker. She did not GIVE it away to anyone.

2. The DNA samples on her were not necessarily from sexual fluids. They were old trace DNA and could have come from the close contact her business brought into with a variety of men.

3. She cried rape only after it was suggested to her when she was facing involuntary commitment.

4. Mangum KNOWS SHE IS A HOOKER. She had no expectation of anyone taking her seriously after the initial investigation. But that was enough to get her out of a jam that night. And she had used this technique to get out of a jam once before.

So there is no reason to suppose Mangum was raped anytime that day.

The indefensible Nifong clearly did not believe Mangum's story, ever - but he must have been amazed that there was zero DNA from the players that he could use to make this case seem possible.

It is pathetic, but true, that "possible" was all Nifong needed in Durham. Any LAX DNA, any at all; that was all Nifong needed to sell this case and cover his butt. Then he could bring this garbage to trial where he would almost certainly have gotten at least some jurors to go with him. Maybe more, maybe he'd have managed a conviction...if he could have found some Brodhead-minded jurors, people so stupid as to imagined that DA's should be believed if they sound "certain".

Poor Nifong obviously misjudged just how far away from Mangum those guys stayed. Why? One is forced to conclude that in the same situation Nifong himself would not have steered quite so clear. In hindsight, this is less surprising: Nife has proven he will plunge deep into disgusting territory just to achieve his foul ends.

This "apology" is beyond infuriating. It calls on everyone to forget his arrogant, reckless, heartless lies, his utter unconcern for others, his schemes to live a better life by forcing the innocent into prison.

No, disbarment is not enough.

While intentionally damaging three lacrosse players, Nifong has also hurt his own son. I cannot imagine how the adolescent must feel, living through this horror his father created. My heart goes out to the son, and I hope that he has the strong support of friends and relatives during this ordeal.

Lots of people are expressing their disappointment that Crystal Gail Magnum will not be prosecuted, and surely she deserves to be. But it's pretty obvious that Cooper concluded that she was sufficiently mentally disturbed that he couldn't get a conviction. If nothing else she could argue innocence by reason of insanity. So he chose not to pursue a case in which there was a low likelihood of conviction.

That's reasonable prosecutorial discretion. That's the kind of discretion Nifong should have exercised in the first place, even if he had honestly believed that a crime had taken place but had no corroborating evidence and no witness other than the confused and mentally disturbed accuser herself. (Of course Nifong was never in the slightest way honest.)

So as unfortunate as it may be that justice will not be meted out to CGM, it's one of those things which happens in our legal system. We don't always get the optimal outcome.

Still, I think there will be a lot of justice to go around. Nifong will lose his license and his job and his pension and his savings and probably his freedom. Durham and Duke will be sued and have to cough up many millions of dollars to compensate the defendants. Every Nifong defender will be ridiculed and taunted and in some cases sued. Nifong's accomplices in the Police department and the DA's office will be deposed and investigated and in some cases will lose their jobs and be sued.

It's not a bad start.

I posted at 11:12 that Nifong didn't write the 'apology'. Do you really believe his attorneys didn't know or help draft that statement? Folks, I'm a lawyer in NC - the statement was carefully drafted in a very late attempt to deflect blame gently. The bigger message here was, "I'm human and used the best judgment I could based on the accusation of an accuser who even Cooper recognized 'believed she was raped'.

Think about it gang - do you think his lawyers would admit on national TV that Nifong's 'apology' was drafted by his lawyers? Of course not. Moreover, given that the hearing on his motion to dismiss certain of the allegations in the Bar's amended complaint is set for today, there's no way he would release such a statement without the blessing of his attorneys.

Sheila in Sanford NC asked @ 7:07 about response from Senators Dole and Burr. I wrote both of them asking them to get the US Attorney General to look into this trainwreck. Dole never replied and Burr gave me the standard "let the State of NC take care of the problem" without addressing the fact that the State of NC can't enforce a Federal law. That means neither of our "Republican" senators cares; or maybe they don't want to offend their elite friends in the state government. Cooper puts both those ninnies to shame.

Hey guys, I have solved the case!

According to the N&O, AD Cooper will say on 60 minutes that Magnum claimed that, "She was suspended in mid-air and was being assaulted by all three of them in the bathroom."

So this is what really happened: three Martian shape shifters came down to earth and took the form of lacrosse players and brutally raped her while using a tractor beam to suspend her in midair (they really get off on weightless sex). They also gave her some Martian drugs that caused her to faint, her fingernails to fall out, and her eyes to change color. The Martian drugs also clouded her memory, which is why she has told so many contradictory stories. I also have it on good authority that her new baby has a noticeable green skin tone, which is highly suspicious. (I know that people think that the baby was conceived later on, but in fact the gestation period for Martian babies is 11 months.)

So in the end Mangum was right, but she just didn't realize that it was a case of mistaken identity! In addition, Nifong did not release the DNA results because it would have caused mass hysteria once everyone realized that the reason people behave so strangely in Durham is that a lot of them are really from Mars. But at least Duke is starting a new Martian American studies department so that they can become productive citizens.

So am I right or am I right?

Since this case started I have despised Nifong and his enablers.
I believe his apology, while self-serving is a good thing on balance because it will put to rest (except with the brilliant G88 who are smarter than everyone else) any comments that "something happened". Nifong is saying "nothing happened".

At this point I hope the G88 get what they richly deserve.

If the hooker is so mentally unstable that she is not fit to stand trial, why does she continue to have custody of her children? The two to me appear mutually exclusive.

Perhaps AG Cooper believes the political cost would turn him into a bad guy. CGM is rightfully getting her ass kicked in the National press right now, I'm not sure the AG expected it. He might have believed there would be sympathy for her in the MSM and toned the heat on her down.

As for Nifong...Given the dire consequences for the LAX 3, had Nifong's attempt to subvert justice been successful, I will not be satisfied with anyhting less than complete financial ruin and incarceration in the very system he tried to stick those boys.

Nifong gets credit for at least being interesting, as the false apology has many layers of deception.

First, of course, there is no new evidence and he refused to look at evidence anyway.

Second, he had to defer to the attorney general. As he notes, dismissing the case would have buried it and he was under ethics charges. As such, dismissing the case would itself arguably been an ethics violation and, moroever, would have created impossible racial divisions and, in any event, as it would have been without prejudice, could have been looked at again anyway.

Third, and more interesting, his claim about false accusations working their way through is contrary to his own statements and practice. He said as long as he had a witness, he had to go to a jury. well, cooper had a witness but is not going to a jury. Additionally, we know that he has brought other false rape claims to a jury and that he says DNA is irrelevant.


Fourth, he never explains why he believed they were guilty when he filed the amended charges but changed his mind. He has not seen any new evidence.

People of Nifong's stripe never apologize; if they offer anything, it is the classic "non-apology apology", which uses weasel words such as "if I have offended anyone ...." This attempts to put the person(s) to whom the fake apology is being offered on the defensive for having been offended and / or expressed anger.

Here, Nifong does exactly that by putting a qualifier on his apology in saying “To the extent that I made judgments that ultimately proved to be incorrect,..."

That means that Nifong's "apology" is nothing of the sort and no one should be referring to it as an apology without the qualifier that it is a non-apology apology. He has done nothing worthy of being permitted to exist as having apologized.

Beyond this, Nifong's statement is even worse as he continues to stack lie upon lie about his handling of the case and a complete refusal to acknowledge the damage he has caused.

Nifong is a despicable human being and the NC bar must send a message that he has shamed them and is unworthy of being a member of the legal community. For his actions over the last year, culminating with even considering this statement to be any form of apology, he deserves to be punished far beyond the loss of his job as DA and his license to practice law.

The bit about "new evidence" is just amazing to me. He's admitting that in almost a year as lead investigator he left key evidence out there, unexamined. In 12 weeks, a new prosecutor was able to not only review everything his office had gathered, but also gather "new" evidence that completely reversed Nifong's judgments. Sounds like he is trying to hide behind his own incompetence...

Yesterday afternoon I found myself in "the belly of the beast", in other words, the John Hope Franklin Center, where many of the leaders of the "88" have offices. I thought about how sad it is that hubris will likely keep any of them from apologizing on their own. I then began to wonder what would happen if each of them were sent an "apology opportunity", essentially a form letter they could sign that would state that they had been wrong in their refusal to presume innocence, in their demonization of the three players, and that they apologize for their actions. It would be very interesting to see which of the 88 would sign and return such a letter, and which would not. We could keep a scorecard and update it each time one of the 88 decided to break from the herd and show some maturity and class.

Rushing to judgment were Duke and president Richard Brodhead, who urged the boys to cooperate(as if they were not) when he knew they had voluntarily done everything the police had asked(except not admitting a crime when it was a hoax); in telling a crowd "What they did was bad enough"; in firing a fine man and fall-guy Coach Pressler; in canceling the lacrosse season before the committee report that praised the lacrosse team for their citizenship,grades, and respect for others was issued--thereby making it appear the team was guilty of the felonies charged; in not repeatedly reinforcing the concept of due process(Oh,yes, he mentioned it once while speaking a thesis on "rape"---he assumed the 3 were guilty--as the media did) ;in not condemning the posters of the lacrosse team posted on and off campus when each player (Duke student!) could have been the physical target of some nut-case enflamed by the hate-mongers like Sharpton ,Jackson,and the potbangers, one of whom yelled to castrate the 3 accused); in expelling a Duke player for a private e-mail that quoted lines from an asignment in class by a group of 88 radical; in appointing the members of the radical left faculty (the group of 88) who had condemned the lax team and the 3 accused and were so silent when a white Duke girl reported her rapeto police at a black fraternity party which had a gun and hard-drugs). Shame,Mr. Brodhead. Resign.The truth of Duke's involvement(like the Crimestoppers' libelous poster) will come out--the tip of the iceberg is emerging...the rest will be apparent.

Nifong's Attorney implies that the A.G.'s actions had the benifit of information that Nifong didn't posses. Is it possible that the information in question was evidence of prosecutorial misconduct uncovered in the A.G.'s investigation?

Also... The last card has not fallen in this hand of high stakes poker. The N.C. Bar Assoc. has a track record of of letting "rogue prosecutors" skate, with a slap on the wrists. The Judge considering Beth Brewer's affidavit to remove Nifong from office, has stated that he would give the State Bar the opportunity to perform its function. If the Bar fails to propotionately discipline Nifong, Will the Judge then consider the affidavit? Further, failure of the Bar to take the strongest possible actions, would be evidence that the Bar is incapable of "policing its own". Would the General Assembly find it necessary to implement an oversight agency for Attorneys? Highly doubtful!!!
I would suggest that reform is in order in the way that the N.C. Bar is governed. I'll bet that Lawyers disagree.

Durham District Attorney Mike Nifong - facing possible disbarment, potential jail time, and certainly a featured spot in hell - yesterday summoned the chutzpah to issue a mush-mouthed apology to the three former Duke University lacrosse players he personally lynched.

"To the extent that I made judgments that ultimately proved to be incorrect," he started like a ninny, "I apologize to the three students that were wrongly accused."

With that, Nifong tried desperately to make himself into the passive victim of false information - and not the perpetrator of a yearlong "rape" hoax that, we all know, he personally orchestrated.

Let's recap Nifong's disgraceful actions of the past year:

The DA was not misled in the case of a stripper who cried, "Rape!" Instead, he willfully covered up evidence that could have exonerated the wrongly accused players a year ago. This includes DNA evidence that showed the players never touched the girl in question, but many other men did.

What's more, faced with a stinker of a case, Nifong lied to God and the media - particularly the all-powerful New York Times, which gleefully and disgustingly conspired in the hoax.

"I made judgments that ultimately proved to be incorrect," he says now.

We live in an age in which no one is willing to take responsibility for his actions. My only surprise is that Nifong did not immediately check himself into a rehab facility, and blame his role in the Duke hoax on some chemical imbalance, drug dependency or dementia.

This may be a last-ditch ploy by Nifong to save himself agony in the civil courts - while not admitting to any misdeeds in this tragic chapter of American jurisprudence.

It won't work. Not now. Not ever.

Apology not accepted.

While Mangum may be let off the hook for her part in this case because of her troubled and documented psychiatric problemetic past, let us hope that Nifong's delusions will not afford him the same.

I just read the profile on Crystal Mangum, and the Attorney Genereal is seriously mistaken by failing to file criminal charges against her. ( profile can be read at http://www.foxnews.com/story/0,2933,265374,00.html ).

The A.G. implies (but does not say) that the woman may not be mentally stable.

The profile shows that she maintained a 3.0 g.p.a at N.C.C.U. AND GUES WHAT IS HER COURSE OF STUDY? POLICE PSYCOLOGY!!!!!

She was quite clearly using her education to work the system. And I agree with a previous poster, by changing her story so frequently, she was effectually begging Nifong to drop the charges. She knew that inconsistancies in her story would prove incredible before a jury. And once the charges were dropped, she would be out of the spotlight.

Thats an interesting point, that maybe all of her false stories are not due to delusion but in trying to get out of the case without having to admit she lied.

From what has been made public though, it seems that she does have mental problems. She's bipolar, has been on numerous medications, has a history of erratic and antisocial behavior and susbstance abuse.

If she really is mentally incompetant then a trial for making a false report would be in no ones best interest. It depends on how serious her condtion is, and we don't have access to the medical record to know that.

As far as I can see though Roy Cooper has done an admirable job so I am willing to give him the benefit of the doubt about not charging her.

I guess the Crystal question boils down to how crazy is too crazy to charge with a crime but not crazy enough to warrant being institutionaled? She is sane enough to keep her children, yet we know that is a not in their best interest, given what we know about her profession and behavior. Maybe jail isn't the right place for her, but I think the streets aren't either.

She is probably gaming the system, waiting for Jesse's money to show up. And when the police department hires her - and they are definitely in need of more officers on the street - they have budget for 20 new hires right now - I know I will sleep better knowing Officer Crystal, with her shiny badge and NCCU degree is on the job. Oh yeah - I'll sleep soundly - far away from this urine soaked hellhole.

I agree, The A.G.'s office has done a good job and maintained a high sense of professionalism. I also give it very high marks for elaborating on why it dismissed the charges. It really could have said that it failed to find probable cause, and left it at that. He went the extra mile and called a lemon....a lemon.

But the last time I checked...it was not the responsibility of the prosecutor to decide if a defendant was mentally capable to assist in thier defense....that is the responsibility of the court. The charges should be filed, and if the Defendant wants to persue the insanity defense, that becomes thier burden.

Nifong definitely wrote the apology as stated above. As noted by KC and others, Nifong begins the "apology" with self-serving, self-righteous statements. He asks us to remember (as milbarge points out) that HE was the one who handed the case to Cooper (although he doesn't tell us why). One could easily believe from his press release on city letterhead again, that he was the "hero" in all of this. Afterall, he "didn't have to turn over all the evidence." ????!!!!

Only after he gets through his agenda does he bother to apologize. In my line of work we use the word Narcissistic very carefully, but the rages (i.e. in the courthouse), the blindness to others, the specialness he feels both at his "luncheon" and even now after mowed down by the AG only offer further evidence this is a man with HUGE Narcisstic tendencies. BTW, good therapy for NPD doesn't exist.

Governor Easley put a "period" on the case. With Nifong still in office and healing at Duke still to go, not to mention the families, we are far from beginning to heal. We are still cleaning out the wounds.

Make no mistake, that apology was drafted for Nifong to toot his own horn. (No one else will!) The apology is simply an after thought or a convneient reason to get a word in edgewise.

I live within just a couple of blocks of where the "alleged" attack occurred. I also deal with many hundreds of our neighbors in a professional capacity each day.

The local approach is about compensation.

Precious Panties is not a sociopath, nor is she unique. She was trying to collect reparations from convenient and vulnerable sources. (perhaps this is your point). The (not so ) Reverend, Jesse Jackson, and the New "Black Panther's Party" continue to turn everything into a "compensation" issue. Now let's talk about compensation for the Duke 3. Thier families already have money....more money probably wouldn't make a difference to them (but more power to them). I think justice would be served if we outlawed civil rights violations that were initiated by blacks as well as whites etc. Imagine if we had an american caucasion college fund. Its time we erased race from the vocabulary of society. Dr. Martin Luther King said it pretty well when he said that we should judge a person by thier character and not the color of thier skin. I agree. The black community uses those words when they are convenient....let's apply them all the time!!!!

Agree with most of your points, but I still maintain that it takes a down-and-dirty sociopath to casually sit by and let innocent people go to prison for 25 years.

As to your point re "civil rights," blacks will always be arguing for quotas based on disparate impact, racial disparity nonsense.

The government should not aid them in their breeding behavior. That's the only solution that will work over the long term, because the so-called cognitive "gap" will never close an inch.

Nifong's claim to have exercised "judgment" is nonsense.

Judgment assumes that you make a good faith effort to get the facts and then make a reasoned decision.

Nifong spurned the facts, didn't read the data, acted on pre-disposition malice or both and concealed evidence that shows he was no acting in good faith. he can't now claim it was "bad judgment." What a total disgrace to the legal profession he is.
