Federal Inquiry?

ABC-11's Tamara Gibbs is reporting that federal investigators are on the ground in the Triangle, as part of a process that could culminate in a federal criminal investigation of Mike Nifong and his law enforcement accomplices.

She reports,
Disbarred District Attorney Mike Nifong's troubles may be far from over. And that may be the case for several individuals that were closely involved in the Duke Lacrosse case, according to Eyewitness News sources.

While Attorney General Roy Cooper is considering a request to investigate public officials that handled the case, ABC 11 Reporter Tamara Gibbs has learned federal investigators are collecting testimony and other court documents from Mike Nifong's ethics trial and his recent contempt hearing.

Sources say the U.S. Attorney's Office Middle District of North Carolina is considering whether to investigate the case. Investigators are trying to determine whether the civil rights of the former defendants were violated. Numerous calls to the U.S. Attorney's Office were not returned.

I suspect that not only Nifong but also Sgt. Mark Gottlieb and his superiors, ex-Investigator Linwood Wilson, Dr. Brian Meehan, and SANE nurse Tara Levicy will sleep poorly tonight.

Geez, talk about being late to the party. Much of the heavy lifting has been completed for the Feds now that, evidently, they've decided to get off their asses and contemplate enforcing federal civil rights statutes.

However tardy, the Feds are more than welcome, obviously. There is still much, much more work to do here.

They aren't "late to the party." The feds need time to develop a case and they are doing it in the right way. They had to wait until the other hearing was done before they could move in. Expect to see Nifong and others face some serious prison time. My only hope is that Crystal Magnum goes to prison too. She belongs there.

Absolutely. She has no protection due to her mental health(?) history. We put people in prison all of the time with major mental health diagnoses when a jury deems that it had no relevance. Unless you were grossly psychotic, couldn't process right from wrong, at the time of your crime you have no mental health defense.

I have never understood why she has been so shielded from her criminal actions.

From what I understand when the cops took her to the initial mental health crisis unit she was neither grossly psychotic, homicidal nor suicidal which would have put her in the status of an involutary hold. She could process her surroundings and circumstances and figure a ticket out, which she did thanks to the incompetent nurse interviewer.

Everyone tries to say it's a conservative show, but that's simply not true.

He has both sides represented always.

But forget about ideology.

That show is the NUMBER ONE cable show and KC would have so much more exposure.

I talked with Stephen Miller, the wonderful columnist and Duke alumnus who came in from L.A. for KC's Duke appearance, and he is trying to get a job at FOX because of the popularity among national audiences.

He appeared on The O'Reilly Factor during the lacrosse Hoax and while he was still on campus this past year.

He's an amazing guy and I'm sure he will do well in that profession.

I hope KC has the time for a few more TV interviews before he leaves.

Use the search string "KC Johnson Duke" at www.YouTube.com. There are 6 segments about 10 minutes each which seem to cover most of the lecture presentation. I think the introduction of KC by others and some of the Q & A session afterwards were not recorded.

The video is poor, but the sound is acceptable. Thanks to "devilbear" for posting the videos.

I would have said that with ex-DA disbarred, Duke and Durham shelling out $millions in damages, and academic political correctness--country-wide-- taking a hit that could well be the beginning of its overdue comeuppance, that justice has been done and the Feds might as well butt out.

That is until that ghastly display last week of non-remorse and nothing learned, zilch, zero, nada, that had Mr. Nifong and his last-ditch partisans marching to the jailhouse like Jesus and the disciples on their way to the crucifixtion.

I suspect the Washington, D.C. bosses inappropriately asked...What's up with Duke and Durham?

Durham city officials' recent about-face about who was "in charge" of the investigation revealed, once again, that somebody--many folks, assuredly--lied under oath.

The scramble to self-preserve is on in Durham. It will be fun to watch and see which scum-bags turn on each other. Any predictions about who will be (or was) first to flip state's evidence for the FBI?

"First, the Duke lacrosse case. Not to condone such behavior, but college boys have been having such parties for eons. This one got out of hand for a varity of reasons, but the situation really got out of hand when the prosecutor's office adopted an overly zealous approach toward prosecuting three young men"

It's all good so far though the price was very high for the lax team, three guys esp. and their families.

Should a complaint against Judge Morey be made to the State Bar for her testimony at MR. Nifong's contempt trail? What she claimed on the stand is clearly contrary to the practice of law, and she said it under oath.

I watched the YouTube videos, and while the video itself was not good, I think one gets a sense of what went on at the event. Of course, K.C. did a good job, and I think he was quite fair to the people involved. He certainly did not stoop to the level of the self-righteous faculty and potbangers that disgraced Duke University for years to come.

Remember this: K.C. Johnson is an elite scholar. He has the intellectual capacity AND the academic record to be more than qualified to teach at a Duke, a Harvard, Dartmouth, Stanford, you name it. That being said, I think it is instructive that a person from outside Duke had to come down to explain to some people there the fundamental issues of how faculty members at elite institutions are expected to behave.

Keep in mind that K.C. was NOT telling Duke faculty members how to think. Instead, he was reminding them of something they already should have known: how to ACT.

Re; Manley/levicy
A detail I read in UPI got my attention. Apparently, the ER Doc Manley said she at first belieived a rape had actually occurred because of CGMs demeanor and some vaginal fluid present. (It was yeast infection). It seems obvious that Manley most likely shared that perspective with the impressionable, brand-new SANE Nurse Levicy. And that input from an MD put substance into her willingness to fall for Gottleibs invitation to confirm a rape scenario.
But Manley said she re-thought the matter when she heard about the DNA results. Anybody who understood the implications would have done so. Levicy, however, according to defense lawyer interviews, started re-molding her account of that night to fit around the absence of Lax DNA even to the point of contradicting her own signed report.
If all reports of her statements harmful to the innocent accused have been false, she sure has passed up a lot of opportunities to undo the damage.

Very interesting coverage on the lacrosse case just now.

The local station went out to ask some Durham taxpayers what they thought about the upcoming 30 million dollar lawsuit.

Of the four people giving their opinions:

--One middle-aged white lady was very upset that it was going to cost each taxpayer $150 and she doesn't want her money going to rich kids who don't need it.

--Another white older lady said that it was fair since their names would forever be linked to the false rape charges.

--An older white guy said it was fine with him because of the way they have been treated by those in Durham who were assigned to be in charge.

---But the very best response was from an older black guy who said that this settlement was EXACTLY RIGHT and that he agreed with the lacrosse families. He said that if people in Durham are upset about it, they should choose their leaders better.

LOL!!!

Three out of four responses were on the side of the lacrosse players.

(Of course, Victoria Peterson didn't show up for this photo-op.)

I think that O'Reilly, and anyone else, should give maximum exposure to Wendy Murphy, 88ers, and as many of the academented as they can get on the air. They harm themselves every time they open their mouths. The smarter ones know this (i.e. no recording devices allowed at Shut Up and Teach) and do their dirty business in secret. The stupid ones jump at the chance for 15 minutes of fame.

Give them an hour. Or two.

I am a bit disappointed. I would hope that the tenor of this blog would be equal to the severity of the potential investigation. Outrageous claims and bitter hyperbole do not advance the cause at this point. Reasoned discourse is surely needed, for if there is a Federal investigation, this blog may/will be surveyed for content and leads. Accordingly, comments should be directed toward truth as one knows it.

This blog and related comments may very well be viewed as a de facto deposition. If credible, then it may be viewed as a factual basis for a Federal indictment.

I, for one, believe that there were egregious violations of the victims civil rights. But that is a conclusion best determined by a rule of law.

I would provide a voluntary and public deposition to assert that position.

Levicy was not a lowly staff nurse. She was the one person in the ER that day paid to generate trial-grade evidence regarding sexual assault. And it was her statements alone that had entered the public record and were doing great harm to innocent people.
Of course, if she never actually said what Gottlieb and Kingsbury alleged, she will have nothing to worry about.

You have got to be kidding if you think redneck prof's are the answer to G88 prof's. What is needed is quiet, fair and sincere prof's of all races and genders who are passionate about their students educations to step up on campus. College campuses are a place where students should find many subjects that expand young minds, train them to think independently, express themselves clearly and find their own individual passions to bring to life. It's a special time in a young persons life where ideas can be explored and futures found. Some of the bloggers here aren't any better than the G88 in wanting to poliiticize the scene. No argument the G88 created the present problem, let's not make it worse with extreme right wingers who actually are not that different from G88's.

Did anyone see the WSJ article this past week about MIT and the administration's total lack of cooperation with an alumni parent from CA who came to look for her missing son after he disappeared under very suspicious circumstances? MIT wouldn't let the mother in his room (she apparently picked the lock herself with a kit she brought from home), and MIT refused her access to his computer files (which she ultimately hacked into on her own). Everything she learned she learned on her own. MIT refused to cooperate, even after the kid was listed as a missing person. It turns out the poor fellow was dead, but it is not clear whether he might have been reached in time had MIT helped the parent.

Now, I am having difficulty reconciling MIT's position with the mother and Duke's position with the police. MIT seems to have adopted its adversarial approach to parents based on the conviction that students rights to keep secrets from their parents (ie, alternative lifestyles)trump every other consideration. Yet, Duke seems to have willingly compromised the privacy rights of its students, even though neither they (nor anyone else) faced mortal danger. One thing both universities seem to have in common though--they both seem to be in the wrong. Anyone care to take a crack at explaining how all these intellectual superstars get so confused?

I hope the Durham Holiday Inn has this on its marquee: "Welcome FEDS!" And I hope I am not getting too carried away, but I would go even further and say, "Great things are happening in Durham."

Trial grade evidence - what are you smoking. She was paid to collect speciments and do a QA. In most hospital the Physician collects the samples. The certification for this SANE thing is a 84 hour course given at the YWCA. Not at even BSN level. Any staff nurse can take the course. Dr Manly did collect the samples, Neither SBI or Meeham's lab complained about the samples, so I quess they were "Trial grade." The AG said the exam exonerated the team. All a SANE nurse does is testify to the how, when and who they collected the samples from. SBI testifies to the DNA results.

1. Nifong, for obvious reason

2. Gottlieb, for his "notes."

3. Wilson, for the cabbie situation and his "interview" with Mangum.

4. Meehan, a slight possibility here. It is more likely that his firm will face a huge lawsuit from the former defendants.

Himan is probably off the hook. There may be others worying in the Durham County DA's office and the DPD.

Those not worrying tonight include:

A. Levacy, no one anywhere that I have seen has suggested any credible theory of a crime she might have committed.

B. Brodhead and anyone at Duke, again no credible theory of what crime they might have committed.

C. The Judges unless Nifong can role on Stevenson and claim he advised him to prosecute these guys to win the primary. But otherwise the FEDs are not going after NC judges.

D. Addison, being a PR guy for a police department even one breaking the law is NOT a crime.

Notice the keep dichotomy, those worrying are those who acted using the power of the state to frame three people. That is also what needs to be stopped, so it is appropriate that those are the people worrying.

Unanswered Question: I was shocked when I read that Duke students are required to live on campus for the first three years of college. What's the idea behind cocooning students like this?

Fair disclosure: When I was in college, not even the freshmen were required to live in dorms -- and I didn't. There were plenty of dorms, on campus and off, but there was no requirement to live in one.

What is needed is quiet, fair and sincere prof's of all races and genders who are passionate about their students educations to step up on campus. College campuses are a place where students should find many subjects that expand young minds, train them to think independently, express themselves clearly and find their own individual passions to bring to life. It's a special time in a young persons life where blah, blah, blah...

I remember sitting in my Criminal Law classes in law school and thinking they should have my oldest brother -- a veteran deputy sheriff -- come in for a guest lecture. Not only is my brother funnier'n hell, he could tell these kids how the law really works on the ground level. I thought at a minimum that they should take us down to the jailhouse or on patrol in police cruisers (not all at once, obviously!) so we would see the system in action. Nah, we just sat in class and listened to the quiet, fair, sincere profs of every race and gender drone on, and then went to the law library and read the dry law texts ... but yes, expanding, clearly, expressively, and passionately...

If the Feds really do get a hold of this, I wonder who will flip on whom first. My money is on Linwood Wilson. While not the main character in this opéra bouffe, he seems to be the biggest weasel.

As far as Brodhead is concerned (anon. 10:09), he will survive if the Board of Trustees so decides. Since the whole lot of them have taken a see no evil, hear no evil position, they will let him go only if he becomes an even bigger liability to them. If Brodhead has survived this long, I suspect that he will be there for a while (unfortunately), unless KC's book creates additional pressure on the institution. Remember that Nifong has received most of the blame in the press so far, so the question is whether KC's book will manage to shine more of a light on the administration as well.

Funny that the older residents who gave their opinions were very supportive of the lacrosse players.

They are also the ones most likely paying the bulk of the taxes over there.

My guess is that many are as fed up with the people who run the place as the rest of us are disgusted just as observers.

The black guy who responded was really the most expressive and you could tell he wanted people to know how upset he was at how things were handled in his town.

Pity that we don't hear from people like him more often.

Nifong went on TV saying that the Sexual Assault Nurse gave information that indicated that an assault did happen. Levicy is the only person in the ER that day the cops spoke with. Terrible things began to happen to 3 entirely innocent kids. Levicy was as aware as any other trained sexual assault nurse that the absence of any skin,sweat,hair DNA of the accused on/in the accuser - when combinded with the story she heard first hand from the accuser and recorded immediately - completely ruled out any truth in the allegations. And never said anything to stop the what she could have stopped in a heartbeat. Clearly, she did not want the nightmare for the boys to be stopped.
No forgiveness. Long memories. Lots of lawyers.

*Ok, I'll start: There were these four rabbis arguing over a theological point. Three of them, including Rabbi Debrah, agreed and one, Rabbi Horwitz dissented. So Rabbia Horwitz went off and prayed for G0D (that's a zero, so technically I'm kosher) to give a sign. Suddenly over the assembled rabbis the clouds part, a bright light shines forth, and a voice from Heaven booms, "RABBI HORWITZ IS RIGHT!" Oh, how I would wish that they would sleep poorly. But so far we have seen NO indication that they understand their situation, or that they have any remorse for their complicity.

THE KEY TO ALL THIS IS CRYSTAL. FIND OUT WHY SHE HAS BEEN PROTECTED. THEN THE PIECES WILL COME TOGETHER.

It's like working a jigsaw puzzle. KC has done a stunning job of pulling together so many pieces and connecting the segments. But the MIDDLE of the picture is a missing piece. And that is Crystal Magnum and the unanswered questions about:

1. Were any of the DNA samples found on her linked to anyone related to the DPD, Duke, or anyone else of significance in this case?

2. Why was she not even INTERVIEWED by Nifong for many months, yet he called her "my victim"?

3. What can officials at UNC-G tell about her actual student standing?

4. How come SHE showed up at the party when the LAX had asked for white or asian girls? ( Kinda shoots the race card here, doesn't it... about white guys exploiting pore ole black girls?)

Crystal Magnum is the missing piece. Until she is figured into the picture, the story will not make sense.

Meanwhile, the whole HOAX may actually be doing some good. It's like using the flashlight to look for something you lost in your house and "accidentally" discovering a rattlesnake nest.

Most of us just didn't know how crippled our institutions had become. Now, because of the LAX case and particularly because of the scope and credibility of KC's book, we have the flashlights working and we have discovered some formidable rattlesnakes.

I'm not usually excited about the Feds coming into a state. But in this case, I think we need some snake catchers that have better eyes and use better nets than the Durhamites have been willing to put forth. So welcome all! Turn on the lights, and lets clean house.

I think the continuing debate about Levicy and her state boards is useless. Unless you know something I don't ( I have a Masters of Science in Nursing and have TAKEN State Boards in NC) the State Board of Nursing is charged with lisensure issues. If Levicy is convicted of some crime, the Boards of either NC ( she probably still holds that lisence) or NH would likely review whether she could keep it. But the Board, IMO, would be out of order to pull her lisence BEFORE she was convicted of something. Just my opinion. Really need a Nurse- Lawyer to weigh in on this, and there are such.

There is a fair amount of evidence which strongly suggests that Durham authorities conspired with Duke officials, at some level, to deny the lacrosse players their civil rights. Here's a few examples:

1)The Crimestoppers wanted posters which accused the players of committing horrible crimes were distributed around campus and were very likely the collaborative efforts of Durham police officer Addison and Sam Hummel, a Duke employee and anti-lacrosse player activist. Dean Sue and Duke police chief Robert Dean are/were on the Crimestoppers Board.

2)The 3/29/06 meeting between Durham authorities (including the city manager, the police chief,several other police officers and an attorney) and senior officials from the Duke police was not routine. The following were likely discussed at this meeting:

a)Preliminary DNA results from the SBI lab which showed no matches to the players. Durham authorities received these results on 3/28 but they were not made available to the defense attorneys until 4/10. It's likely Duke knew these results prior to 4/5/06 when Brodhead announced that the season had been canceled and the coach had resigned ( was terminated ). This is also why the professors rushed to get the listening statement published on 4/6 since they knew that the release of the negative DNA results would have clearly weakened the impact of the statement.

b)The Ryan M. e-mail which was sent anonymously to the Durham police on 3/27/06 from the following e-mail address :Dukeblues44. We know,from Himan's deposition, that Nifong was receiving information on the case from a woman who worked in his office and whose husband was with the Duke police. This e-mail address sure sounds like a moniker for a Duke cop.

c) Players key card information. On 3/31 Duke police, in violation of FERPA, provided Gottlieb with the players' key card information. In early June Duke sent the players letters saying that Duke had received subpoenas requesting that it release the key card information ( which, unknown to them, had already been released)and would do so unless the players engaged attorneys to file a motion to quash. Duke and Durham clearly collaborated in a fraudulent scheme to cover up Duke's actions in releasing the players' information , unlawfully, two months earlier.

d) Photo ID's / lineups. According to Gottlieb's deposition Duke police, apparently voluntarily, provided him with the players photos in an easy to use CD format. These photos were used in at least two of the illegal photo ID's/lineups ( 3/16 and 3/21)in which Crystal failed to identify her alleged attackers. The Durham police did not have any other photos of the players until the players pictures were taken on 3/23 in connection with the NTO. The lineup in which Crystal " identified " her alleged attackers was,I believe, conducted on 4/4. I believe Duke police were well aware of these illegal lineups.

3) On 4/13( ? )Durham police entered Duke's campus, without a search warrant,and attempted to interrogate lacrosse players in their dorms knowing that the players were represented by attorneys. Duke police cooperated fully in these unlawful activities. When asked about this violation of his students civil rights, President Brodhead had nothing to say.

4)Duke SANE nurse in training, Tara Levicy, was a key enabler of the hoax as she told changing " stories " to accommodate the DA's changing case. In Nifong's testimony at his ethics hearing, he continually referred to Nurse Levicy as Tara, indicating a friendly working relationship.

5)In addtion to the key meeting on 3/29, it's apparent that there were regular meetings/discussions between Durham authorities and Duke officials, in particular Duke police. I believe Duke knew that the case was very weak and the players were being railroaded and yet they collaborated with an unethical DA , and some apparently corrupt Durham cops.

I know that I've connected a few dots here but the dots are awfully close together. Hopefully the Feds will investigate and prove the conspiracy theory hypothesis. Has a University, or its employees, ever been charged with RICO violations ?
