Checks and Balances

We no longer need to wonder if an ethics complaint has been filed against Mike Nifong before the state bar. A Neff/Niolet/Blythe article in this morning’s N&O reveals that at least 17 complaints have been filed--made public not by the state bar, which legally cannot do so, but by the attorney general’s office, under public records requests. It’s my understanding that additional, and more comprehensive, complaints exist as well.

Moreover, one defense attorney, Michael Cornacchia, has urged federal intervention. He called on the U.S. Department of Justice to open an investigation, on the grounds that Nifong had violated the civil rights of the three players. Cornacchia, formerly chief investigative counsel for the probe of the United Nation’s oil-for-food program, is a legal heavyweight, and the justification for federal intervention, it seems to me, is overpowering.

As Neff notes, Nifong seems well aware of the threat: “In court, news releases and at news conferences, the prosecutor has responded to the criticisms against him, at times using language that sounds like an opening argument he might make to the State Bar in his defense.” Indeed, at this point the determination of the “minister of justice” to proceed has less to do with “justice” of the accuser’s “right” to a fair trial and more with a need to come up with some sort of justification for his actions that he can present to an ethics inquiry.

Two important quotes from the article. UNC law professor and former federal prosecutor Richard Myers: the defense calls for federal intervention are “a fairly strong indication the defense has nothing to hide if they want more eyes on the ground.”

North Carolina defense attorney Mary Ann Tally: “If they are complaints that have to do with what is going on right now and will continue to go on until this case is resolved, I guess the question I have is why isn’t the bar doing anything about it right now? It seems to me there’s a tremendous amount of pressure on the bar and a lot of public expectation on, ‘Can you do the right thing, and can you do it in a timely fashion?’”

Tally’s question is an excellent, and unanswerable, one.

I was thrilled to read this article. Finally, something tangible to indicated someone besides us with direct authority is paying attention. Perhaps Cash Michaels and whoever else is telling us how irrelevant blogs, comments, and our views in general are will not have the last say. Thank you again for your excellent work, bloggers. I am sure your efforts will be very helpful to the NC Bar and the Feds. You have assembled a treasure trove of information for them.

A poster (NC resident, I think) on Free Republic said that they couldn't decide what was more embarassing, Duke or the legal system in NC. I'm not sure that's a horse race upon which I'd like to bet. ;>)

Was it a G88 member who called DukeLAX a 'perfect storm' at the outset? They were right, but the 'perfect storm' appears to be one of cowardice on Duke's part and malfeasance on the legal system's part.

Is it possible that the NC State Bar is reluctant to come down hard on Nifong because of the possibility it would subsequently significantly help a plaintiff's case in the event of a financially damaging civil suit?

Moreover, at least two others quoted in the article have connections to the Duke 3.

Innocnent people have nothing to hide, and why would Nifong be afraid of a trial. So, he should simply let the evidence develop and not offer a response. In fact, given that there is strong interest in his conduct and it is dividing the community, a trial must be held.

Trials are not held because of interest of the community or community divisions-- they are held to determine guilt or innocence of specific defendants on specific charges.

No one will win at a trial. The emotional and financial costs to the defendants are astronomical. The accuser will face a devastating cross-examination. Community divisions will be increased. A trial is a lose-lose proposition. Not all charges are brought to trial-- the DA is supposed to chose which cases merit charges based on evidence, not on political necessity. The charges should have been dropped long ago.

A second comment on the Neff et al. article. I don't like the subhead:

"Mike Nifong's detractors in the Duke lacrosse case want him punished for forcefully pursuing charges"

Nifong is being criticized for prosecutorial misconduct and not for "forcefully pursuing charges."

Nifong's pandering to the masses:

"I'm not going to allow Durham's view in the minds of the world to be a bunch of lacrosse players at Duke raping a black girl from Durham," Nifong said at a forum televised live April 12.

He should have added:

'Instead, I'll make sure that 'Durham's view in the minds of the world' will be that we're a town where the DA is politically motivated & the police are corrupt, and the denizens don't seem to care.'

The headline about forcefully pursuing charges indicates the split personality of the N&O and suggests that some editors there remain as Nifong enablers. Neff's work has been outstanding and some of Niolet's work has been, too. Wasn't Blythe's byline one of two on the inflammatory and fundamentally misleading March 24-25 coverage? And which of Sill's and Williams' editors wrote this headline?

By all means, if and when Michael Nifong appears before the Bar committee, he should appear alone, because no less an authority that Mr. Nifong himself has declared that innocent people don't need lawyers. (I acknowledge that numerous posters have said this, and I am copying them.)

Furthermore, I think it only appropriate that other attorneys laugh out loud whenever Nifong or one of his attorneys makes a statement. Sarcasm, braggadocio, belching, and the occasional passing of gas (done very loudly) need to be part of this proceeding. It seems only fitting, given Nifong's bizarre and disgusting courtroom behavior.

(Why judges put up with it further confirms the absolute corrupt nature of North Carolina courts, and declares that courts are nothing but playgrounds for prosecutors.) For that matter, I believe that a sign needs to be posted at the courtroom doors:

YOU ARE ENTERING A NORTH CAROLINA COURTROOM. ABANDON ALL HOPE, YE WHO ARE INNOCENT OF WRONGDOING.

A few pictures of the Little Rascals defendants, Darryl Hunt, and Alan Gell would be good decorations for this hell on earth.

My point was that the whole idea of letting "trials" play out is always a good idea for other people. When it is your skin in the game, raise every delay and technicality you can, as Nifong will almost certainly do.

Two things. First, I was being facetious, but the Great Michael Nifong Himself is the Grand Authority who has declared that innocent people don't need attorneys. Since he seems to have a number of supporters who write comments on these pages, I figure that the Great Master of Justice needs to follow his own ex cathedera statements.

Second, the Fourth Estate, which is made up of mainstream news organizations, generally has failed. Most journalists have government officials and politicians as their main sources, so they usually are mouthpieces for the government or at least for someone who receives a government paycheck. Editorially, I rarely read a newspaper that does not endorse even more power to the state, mostly through regulatory agencies.

Thus, I declare the blogs to be the Fifth Estate. K.C. and company are helping to lead a new and important movement.

That last comment is NOT facetious! Future prosecutors who break the law are going to be on notice that the Internet is a most powerful tool for dispensing sunlight and disinfectant.

Nifong is a lowlife, but not an idiot.

He knows where the 'edge of the law' is and despite his abuse of it he won't get more than wrist slap from the legal system - an institution incented to protect its own.

Only caveat is if an DA Office 'insider' provides incriminating evidence of Nifong's corrupt motives.

That's all there is hope for - perhaps ADA A. Cannon cares to clear her conscience !

I completely agree, the blogs and the Internet are the new 5th Estate. It is a momentous shift in authority. I have been an avid reader of the NYT and the WSJ for many years. Their abysmal coverage of this important case has completely changed my views on the value of newspapers. The blogs offer much greater transparency and flexibility. Incorrect material can be pointed out and alternate interpretations and nuances can surface almost immediately. Duff Wilson's Aug. 25 piece in the NYT permanently altered my relationship with that newspaper. Now, instead of racing for the newspaper in the morning, I log on for my news. I suppose I will continue to subscribe to my newspapers, but I will read everything while wondering what lies they are propagating and why. Some might say I was long overdue for this sort of revelation.

"Billie Boy" used to be a newspaper reporter, and he had much contact with journalists across the country. And the journalists with whom I have spoken in writing on the Duke case have agreed with me wholeheartedly. One of them agreed that the use of government sources can be very problematic.

The main sources in this story, other than one with the AV, have been Nifong and the police. The lawyers long ago were gagged.

Yes, journalists interview others, but government sources are pretty much the main pool.

I mentioned Duff Wilson because I did not remember the name of the co-author, and I did not want to look it up. My apologies to the co-author. I did not know Duff Wilson was black. As for the AV's appearance, I would assume she is reasonably attractive--seems like a job requirement for a stripper/escort. The pictures of her from the phone camera are blurry. I do not know how her appearance one way or the other would add much to the volumes of exculpatory evidence. I suppose you will be able to make a judgment on her appearance when the trial starts.

Indeed, the issue IS a legal one. Nifong threatened to indict everyone who was at the party as an accessory to rape, which was one reason the players got lawyers. The unindicted players all have supported the Duke 3 via signed affadavits, but they still labor under Nifong's threats.

Also, the players are likely to be defense witnesses if there is a trial, and if Nifong indicts any of them, that will make it more difficult, obviously. Also, no doubt Nifong would hold a "testify against the Duke 3 and you will walk" deal over their heads, so the players have decided to stay quiet.

Now, Glenn Nick has said some public things on these threads, but even he has to watch what he says. Therefore, the "silence" is not a lack of support, but rather a cautionary move. Given Nifong's procilivities to indict on lies and the potential jury pool in Durham, one can see why the players are not banging their own sets of pots.

Also, the public statements by Brodhead of "whatever they did was bad enough" also have tempered any attempts of the unindicted players to speak out. Remember, they were viciously attacked by faculty members, other students, Nifong, the police, and the Duke administration. One cannot blame them for being quiet until the right moment arises.

I agree that the silence of the unindicted lacrosse players is puzzling, especially since Nifong has said that he does not intend to seek charges against anyone other than the three indicted players. I suspect they are worried that if they issue some kind of statement, they will come under pressure to answer questions from the press about what happened at the party, and they do not want to put themselves in the awkward position of having to answer those questions and have their faces plastered all over the media in connection with this story. Better to maintain a low profile.

Sadly, it is taking Money/Power to insure Justice is not denied. The system is supposed to protect the rights of the accused. The free press is supposed to shine a light into dark corrupt places. The leaders of our nation's institutions are supposed to take to their bully pulpit to challenge mediocrity & mendacity. All of those have failed.

What a sad picture this entire episode paints.

It would be foolish for unindicted LAX players to rely on Mr. Nifong's statements that he does not intend to seek charges against the other players. He could reconsider his position on that at any time. But it would be interesting to hear what they have to say.

In response to some comments posted above, it seems to me that it would not be proper for the Bar Association to intervene in a pending criminal case, even if there are indications of prosecutorial misconduct. I would think that the proper procedure would be to let the proceedings play out, presumably with the result that the court dismisses the charges for lack of evidence or the jury returns a verdict of not guilty, at which point, the Bar Association would begin an ethics investigation. This may be painful for the players, but it seems to me that if the Bar Association jumps in before the normal procedures are allowed to play out, the effect would be that the Bar Association is usurping the authority of the court and the jury to resolve the indictments handed down by the Grand Jury, which I think would be improper. Perhaps KC or a knowledgeable member of the audience could enlighten us as to whether any Bar Association has ever intervened in any criminal case in this country prior to the conclusion of the proceedings.

I am not sure that the Department of Justice can jump in here either because under our system of federalism, the federal government is supposed to defer to the states on matters of state law, which would include allegations of rape. Although I am not an expert on civil rights law, I can see that after conclusion of the state criminal proceedings, DOJ might be able to prosecute Nifong for violation of the civil rights laws, though I think that would be a difficult prosecution because district attorneys are given a lot of discretion in handling their duties, not the discretion to violate civil rights, but still a lot of discretion. I would think that the only way for the players to vindicate their rights is by following the normal criminal procedure of trial and appeal, and presumably at some point either the trial court or an appellate court will make proper rulings on the constitutional issues. After those proceedings are concluded, DOJ or more likely the state bar association would have their shot at Nifong.

It seems to me that "prosecutorial misconduct" is a charge that can only be made if a defendant is wrongly convicted as a result of the prosecutor's willful mistakes. If so, the NC Bar might not be able to intercede unless a verdict (of "guilty") is reached. There are other ethical violations on which the DA could be charged, but in general DA's have wide prosecutorial immunity--which protects them from being charged every time a defendant is found "not guilty." There are only a few very specific things that the DA can actually be charged with--making extrajudicial statements that he knows are false and that prejudice the community is one of the things that qualify--but I believe the defendant still has to be wrongly convicted (i.e., convicted and then, on appeal, have the conviction overturned because of the errors of the prosecutor) in order to file charges. Maybe an attorney can comment???

One other thing re: prosecutorial misconduct--by appointing himself the lead investigator, Nifong may have put himself in a more vulnerable position with respect to misconduct, enjoy a lower level of immunity.

The 3.28 raises an interesting point--an issue (when and under what conditions have Bar Associations in the past traditionally intervened) I'll try to explore in a future post.

There is one most unusual item here, however. The bar's responsibility, as the Neff article looks out, is not to punish Nifong or aid the players but to safeguard the public.

Information has been brought to the attention of the bar that Nifong might have violated the ethics code. Can the bar, ethically, allow the issue to remain univestigated while Nifong prosecutes other cases--where he could, theoretically, break the rules again?

As long as this was the only case Nifong was prosecuting, this issue was moot. But, as we know, another high-profile case came along (the quadruple murder) and the "minister of justice" took over that case, too. That decision, it seems to me, increases the pressure on the bar to act.

I would think this should be addressed not through any action by DOJ or by the state bar but rather through a pretrial motion by the defense attorneys to exclude the photo identification from evidence on the ground that it violated constitutional guidelines. As I understand it, if the photo identification is excluded from evidence, the AV also will not be allowed to identify the three defendants in court (because it is obvious that the three young men sitting at the defense table are the three she identified in the photo lineup), at which point the case would collapse.

On the Nifong procedural violations, I agree completely with 4.47(a)--the public comments are the most well-known Nifong violation (and they're a clearcut violation), but instructing police to violate their own procedures is the most serious.

On 4.47(b): ethics complaints and pretrial motions are separate avenues. For instance, it's theoretically possible (though highly unlikely) that Nifong could be found guilty of ethics violations, but victorious in pretrial motions. The first interprets his actions according to the ethics code of the state bar; the second according to relevant state and federal law.

I think there is a lot of wishful thinking going on here. The feds are not going to intervene in a state matter, even with alleged civil rights violations. The spineless NC Bar will likely give Nifong some sort of reprimand or short suspension, at most. The Gell case is instructive in this regard. North Carolina does not have any strong checks on rogue prosecutors except their defeat at the ballot box, and Nifong avoided that fate thanks to a split opposition.

The misconduct and criminal behavior of Nifong and DPD has to be egregious and must fall into certain categories before the Department of Justice and the FBI step in. Nifong and the DPD have crossed that line long ago. They have been compiling information for months. I believe the FEDs stepped in to intervene with Louisiana DA Jim Garrison who used the same tactics Nifong has used whose prosecutorial misconduct Nifong has actually topped. I believe the Supreme court will set a precedent with this Duke case.
Nifongs motives were purely political and self evident. Bring on the FEDS

In Shaw, we detailed then District Attorney Jim Garrison's harassing prosecution of Clay Shaw and the bad faith tactics Garrison employed in his zealous investigation of the assassination of President John F. Kennedy. Shaw represents perhaps the paradigm in this Circuit of impermissible prosecutorial motives. Garrison used his prosecution of Shaw as a means of procuring public support--financial and otherwise--of his larger investigation into the assassination of the President. See Shaw v. Garrison, 328 F.Supp. at 393-400.

Call me a skeptic, but I just do not see the feds intervening in this one, nor do I see the North Carolina Bar doing anything, either. Remember, this case is being driven by political entities, not just Nifong.

We have the feminists, racialists, and other elements of political correctness, and these people tend to be concentrated in academe, journalism, and law. I suspect that many attorneys in North Carolina, given their PC proclivities, are fully in agreement with Nifong and DON'T CARE if there really was a rape or not. They just want a trial and conviction.

So, someone needs to prove to me that the NC Bar actually is going to stand up for three wealthy white males. As for the feds, since when has the DOJ done anything that is useful? Its prosecutions tend to follow the political winds, and there is no political upside for the feds to go after Nifong.

Again, I would love to stand corrected on both counts. But, if the NC Bar was willing to take a powder for David Hoke and Debra Graves after what they did, I cannot see the Bar doing anything about a politically-charged rape case.

Here is a link to a depressing law review article on prosecutorial misconduct by Peter J. Henning--www.law.wustl.edu/wulr/77-3/773-713.pdf. It's entitled "Prosecutorial Misconduct and Constitutional Remedies." Most of the article dwells on how difficult it is to have a prosecutor held accountable in any way for misconduct. And then you get to this juicy nugget, "After Hollywood Motor Car, the only instance in which prosecutorial misconduct that violates due process should result in dismissal of an indictment and a bar on further proceedings before trial is when, but for the prosecutorial misconduct there would have been no probable cause to charge the defendant. In that circumstance the real problem is the insuffiency of the evidence; prosecutorial misconduct is secondary to the lack of credible evidence to charge the defendant." 77 Wash.U.L.Q.713(1999)p.824. Another article by the same author should be interesting too. It is called "Prosecutorial Misconduct in Grand Jury Investigations," 51 S.C.L.Rev1(1999). I have not found it online, yet, but it's probably here somewhere. I believe the risk of bar sanctions for Mr. Nifong are very real--unless the NC Bar is corrupt. And if the Feds or the Bar or a court does not address this situation pre-trial, this will be the case that inspired serious reform...I hope.

And I know the standard for probable cause is very low, but the accusations of a witness who is not credible coupled with lots of powerfully exculpatory evidence surely does not meet even the very low threshold for probable cause. I do not believe that Mr. Nifong can ignore the overwhelming evidence that the AV is lying and proceed with this case--at least not legally...which brings up the idea of a criminal prosecution for Mr. Nifong. Peter Henning makes it clear in his article that criminal prosecution of the prosecutor is one of very few possible remedies available for prosecutorial misconduct.

I think 3:28 is right. The NC Bar will only act, if at all, once the case is over. While I have not researched the issue, I have not heard of the Virginia bar intervening in an ongoing case in my 28 years in practice in that state.

I also do not see the DOJ doing anything unless there is a conviction. They will let the state procedure play out and only if there is a corrupted conviction will they intervene. Even then it might take a federal habeous corpus petition to be filed, post conviction and post appeal, in order for the DOJ to enter even as amicus. I seem to recall that federal habeous corpus relief is not available until the state rememdies have been unsuccessfully exhausted. But again, criminal law and appeals is not my field.

A habeas challenge can occur only after a conviction has been finalized (appeal all the way up the state system and cert denied by the US supreme court). It's possible for an amicus brief at any point on appeal, but hopefully it won't get to that point. If the DoJ were to file charges (civil rights abuses) against Nifong, they would file charges outside of any criminal appeals taken from the case. There's also the possibility that the players could file charges under section 1983 against the city of Durham. Given the flagrant abuses noted here, it seems likely that they would prevail.

It is actually unlikely this case will be dismissed before trial. We are in almost completely uncharted territory. But if ever a case deserved to be dismissed before trial, this is it. And because this case is so outrageous, there is a chance we will break new ground here. That possibility should be welcomed by anyone who holds constitutional protections dear and hates prosecutorial abuses. If Mr. Nifong is brought up short in this case, the precedent will work to the benefit of all, especially, as James Coleman pointed out, those most likely to experience prosecutorial malfeasance, poor minorities. Be thankful someone can afford to pay highly competent lawyers to do this important job. We will all reap the benefits!

As far as Federal intervention: don't underestimate the power of political connections these families of the falsely accused have, don't underestimate the power of the relatives of the falsely accused who will not stop and will take this directly to the Senate, Congress and Whitehouse using their connections, calling in favors to see these young mens lives are put back in place and their names are cleared....no matter how long it takes or how much money it costs. We will not allow Nifong to get away with this unscathed. We will see he is punished to the full extent of the law.
