Nifong Accepts Disbarment

David Freedman, Mike Nifong's attorney, has just announced that Nifong has accepted that disbarment is an "appropriate" penalty, and has accepted both disbarment and waived the right to appeal.

Debrah, you are right and Nifong should have stayed as head honcho over traffic court, but his ego got in the way. Here was his chance after appointment to the DA post to show all those beneath him exactly what kind of chops he had. There was a new sheriff in town, and he was cleaning house.

Then what could be better than a chance to really slap down some of those arrogant Dukie boys?

Don't you think he got a hard on every time someone came to interview him? You could see that he was almost giddy each time that smug pursed-lipped face beamed out across the tv and into the living rooms of millions.

Ego run rampant. Justice is blind for a reason.

As far as accepting disbarment, all Nifong is doing is admitting that he needs to save up his money to pay for the lawyers in the criminal trials, and he can't keep wasting it for hearing that he can't possibly win. At this point, he has to concentrate on staying out of jail.

Amac is right. Lots of folks are depending on Nifong to take the fall for everyone and hope that then things will just blow over. Let's hope not. One down and a couple hundred to go.

Nifong is using the same tactic he did yesterday. Ask for the worst and then hope that it is a shade better...but have the narcissistic satisfaction to know that you "called it" before they did. The guy is a sad sad man.

This may be the opportunity that the 88 will use to apologize and in their apology to point out how their misguided errors were simply a function of that bad man Mike Nifong.

You might consider some internet reading about OCD. Need to avoid obsessive fascination becoming a disorder state; i.e. your family suffering. Just a thought. Your comment may well have been an exaggeration to illustrate your emotions, not a factual statement. Think about it please. (I've only obsessed since yesterday and today; and am making myself shut down the computer now.)

General comment for all:

Many folks have used "sociopath" in the comments. I have some knowledge of the different disorders: sociopath seems to fit. Perhaps more specifically, Paranoid personality with an Anti-Social Disorder. But my slow connection means I've only rest this blog and its comments; no video.

Taking Nifong into protective custody for mental eval may be a good idea; perhaps a recommendation by his attorneys. Not sure if an Open Court think or a private conference among the parties involved.

Anyone else thing so? If Williamson thinks so, you may hear a softened closing comments but the actions (disbarment, taking into custody) are still very severe. This audience just won't get the "We Got Him" emotional diffusion.

I think this whole trial is just a way for the state to show that it can police itself.

When will we see the trial of GW Bush for lying and causing the deaths of many thousands of people?

I'm afraid the conclusion will be that the system works.

And to the comment that this has done something to our democracy, I wish to correct, this is NOT and never has been a democracy. This country is supposed to be a constitutionally limited republic. The problem here was not the abuse of power, it was the power to abuse.

I believe that any aquitted or charged-dropped defendant should have all his attorney fees reimbursed by the state. At the least, the defendent should be allowed the same resources of the state.

When people talk of freedom, they seldom mention that freedom is FROM govenment not by government.

If these defendents had been railroaded drug users where the state uses criminal lying informants, they would likely have no dna to use to prove themselves innocent. In these cases, the prosecutors have too much power, and it's very easy to see them become arogant like nifong.

HE is not the one bad apple in the barrel. The barrel is rotten.

I have no thoughts at all since I am not a licensed physician.

There are a number of legal problems associated with this case and I suggest that we not add to that number by...practicing medicine without a license.

I've done a stint as a libertarian, but age has made me see that there is NO solution for good Government. It's a necessary danger, but unavoidable.

I've come to believe mainly in the founders balance of powers as th e best philosophy. A balance that should be designed continually to pull power from the state since the state by its nature expands its power. But balance can be taken much further than our founders did. Such as requiring every legislative law to have an expire if not renewed date.

Thus, I like your idea in general -- some sort of financial bite back, perhaps making part of the prosecutor's budget subject to civil suit. If it runs too low, the prosecutor is out. It needs to be designed such that OJ doesn't get his money back but the LAX 3 would.

Ruth Sheehan is a columnist for the N&O (a newspaper in Durham). She wrote an article hostile to the lacrosse players, accusing them of stonewalling the investigation, etc.. THe column started out with her now infamous line "We know you know".
Months later she issued a faint hearted apology after being picked apart by the bloggers.

I was shocked that the BAR took the time to point out Nifong's prior good character - it seemed out of place for the situation.

It finally dawned on me that they were sending a message to all DA's that 'anyone is subject to a lapse of character' - don't let it happen 'to you', or you'll end up in the Nifong chair.

Prior good rep is usually a heavily mitigating factor in disciplinary hrgs. But Williamson kept saying over and over, there was lapse that could happen to anyone is they were not vigilant. Key.
